I am due to appear in magistrates court.

My reading was 52. How low can I get sentenced with mitigation circumstances. what are mitigation circumstances for drink driving offences.

For a first offence with a reading of 52 in breath the Magistrates sentencing guidelines advise the imposition of a 12-16 month disqualification and a Band C fine which will be calculated based upon your income. You are also likely to be offered the opportunity to attend the drink drive rehabilitation course which would reduce the length of disqualification by up to 25% upon completion.

In respect of mitigation, this depends entirely upon your circumstances. If there is anything that relates to the offence (e.g. only driving a very short distance) then this can be presented to the Court. Similarly if the disqualification is likely to have a significant impact on your work or personal life then you can also explain this to the Court and as for a sentence at the lower end of the range.
