I was stopped last Friday and had 123 micros in 100 mills of breath, i am an alcoholic but have started counselling, returned to my AA group after an absence of 2 months and have been put on medication from my Gp (antibuse) in order to have total abstinence from alcohol, and am also suffering from depression should i mention this in court andvif i act for myself and will any of this help in a reduction in the sentence. i have a mangement position in the NHS and worked within the nhs all my working life 30years Any advice as to what sort of punishment i will get as i am pleading guilty would be most appriciated.as i am terrified of having to go to prison as i think this would cost me my job. i go to court on 4th September

You are right that the Court will consider imposing a custodial sentence. The maximum sentence that could be imposed would be 6 months in custody. However, you would receive a reduction for pleading guilty early.

The guidelines suggest that readings of 117mg in breath and upwards should attract a prison sentence, subject to any mitigation put forward. I would strongly recommend that you take advice from a specialist solicitor. I am a motoring solicitor and have dealt with cases like yours before. Many thanks for your help in not getting a custodial sentence the 180 hrs community order plus 28 month ban is all i could have really hoped for. Lesson learned !
