1st time offence

Hi, I was caught over the limit a few days ago having mounted a curb and causing damage to some railings. I blew 99 on scene and 108 in the station. I have been bailed to court on 27th Jan. I am absolutely petrified. Can you advise what im to expect? am i going to prison? Im so scared please help.

For a first offence with a reading of 108 in breath the Magistrates sentencing guidelines advise a 23-28 month disqualification and a community order. You should also be offered the drink drive rehabilitation course which will reduce the length of the disqualification by up to 25% upon completion. Although the accident you have been involved in will be an aggravating factor in the case it is unlikely to cause the Magistrates to consider a custodial sentence, they may wish to have a pre-sentence report prepared to aid them with this decision.
