Hi,

I am really ashamed to say that I have been charged with driving while under the influence of alcohol while using a mobile phone.....what is likely to happen to me?

Forgot to add that I blew 80, am I likely to get a custodial?

The Magistrates sentencing guidelines only advise a custodial sentence for a reading of 120 in breath and over so you are highly unlikely to receive a custodial sentence. The guidelines for a reading of 80 in breath are a 17-22 month disqualification and a means tested fine, if this is your first offence then you should also be offered the drink drive rehabilitation course which will reduce the length of disqualification by up to 25% upon completion.
