Is it up to the magistrates whether or not you have to resit your test? even if you're still under to two year probation?

If you get disqualified the revocation procedure does not come into play. It is only activated if you receive 6 or more points.

Revocation is automatic in such circumstances and it is nothing to do with the Court. It is done by the DVLA on behalf of the Secretary of State.

However, Magistrates can order anyone to re sit their driving test if they want to. This would be either an extended test or a normal length test.
 
well i got done for drink and dangerous driving and banned for 15 months and got the chance to do the drink driving course. do you think i'll need to resit? i was still on my 2 year probation..

If you have been convicted of dangerous driving you will have to successfully complete an extended driving test before you can drive again.
