Daughter got arrested and accused of DD August 8th this year. She blew 56. she was charged in 2007 with DD so this would be second offence. went to court with solicitor in sept, asked for adjornment to obtain BACs test. Changed solicitors, used NML, BACs test not through in time for next hearing (Oct), adjorned, attended court November, Bacs test says under the limit at time of moving vehicle. Witness produced to say she drank after moving the car, but solicitor "forgot" to get specialist witness that performed BACs test to attend and sign report. Adjorned again. Attended today, found guilty, 3 yr ban, massive fine, because.................the BACs test cannot count as eveidence ? and the reason they decided tht she is guilty is based around her not telling them at interview that she had drank after the event, I feel they did not listen to her at all and their mind was already made up/ Cost me nearly £2k so far, I want to appeal this, will I win? how much will it cost? can I take action against NML because of the mess last time which has not help. the reason she was arrested is because a bloke was driving her car, he ran off when the police gave him the lights, when arrested he said my daughter as drink driving, she was arrested 3 hours later because she admitted to moving the car after he was stopped, but she moved it only 200 yards and the police agree it was in a dangerous position. Any help/advice welcome
