Charged with Failure to provide a specimen

On Saturday the 26[SUP]th[/SUP] May, I was at my mother’s party all day and had been drinking an exceptional amount of alcohol.
My partner and I had an argument and he left me there.
Later when the party had ended, I got a lift to my partner’s house. At my partner’s house we got into a row and he punched me in the face and I was knocked backwards down the stairs. The neighbours heard the commotion and called the Police. The Police came and as my partner’s parents were stood there and my partner, I said I had fallen down the stairs. The Police took me back to my flat.
At this point, my injuries were really bad – there was blood pouring from my mouth and my eye and lip had swollen up. I realised I had no phone to call anyone (my phone charger was at work and my battery was dead) so I got into my car and stupidly drove to my Mother’s house. Whilst there I called the Police to give a statement against my partner. The Policeman took me in his car and asked how I had got to my mothers. As I was in shock and non compos mentis, I said I drove. The Police officer then read me my rights and arrested me and took a breath sample which read “failed”. He then took me to the Police station where I was then given another breath test. Unfortunately (and I didn’t realise until next morning) as I was crying and hysterical I was unable to provide a specimen and they put me in a cell for the night and released me next morning on a charge of “failure to provide specimen”.
I later went back to report the assault that my partner had done.
Two days later I received a call to say that my partner’s parents had provided an alleby to say my partner never hit me and Police said they were not going to press charges against him.
Now I have the injuries documented by the Hospital, which are consistent with having a blow to the face.

I have spoken to a solicitor and she was going to try and get the whole thing thrown out by the CPS as she felt the Police had acted unreasonable. However, I couldn’t’ get hold of her by the end of last week and she is off sick this week, so I am left with all this worry and distress. I have been told by another solicitor that I will have to go to court on the 11[SUP]th[/SUP] June after all and it will depend on the CCTV footage from the custody suite (I was crying and acting hysterical) and kept saying over and over “one minute I am reporting an assault and then next thing I am being arrested!”

has anyone got any advice on whether or not I stand a good chance or whether I will be losing my licence. Obviously, I will be without a job without my licence as my job is 17 miles away and I am disgusted that my ex is getting away with assault whilst I am being punished. Anyone got any advice/experience?
 
Hello, unfortunately you already seem to have a legal team on board, even if they dont seem very good at answering the phone, as this is the case i can only advise keep trying to contact them. The advice to go to Court is good and make sure that you appear at all hearings, if you wanted to transfer firms to a specialist then funding could be done on a private payment basis only with ourselves, we could then assist immediately, can you confirm if the matter is legally aided and have your current solicitors now been in touch>?
