hi there i pleading guilty last week to drink driving and have a special reasons hearing next month my blood came back at 194 i only reversed my car back a meter when i seen the police pull into my car park. i was only moving the vehicle a couple of spaces across so i could see it from my bedroom window after threats against damage to my car from an ex gf i have a receipt from previous damage will the level of blood reading be a negative factor when arguing special reasons thanks

There is case law with guidelines about special reasons based on shortness of distance driven. One of the factors that the court should take into account is the amount by which you are over the limit. However, the court will take all circumstance into account, particularly what they thought your intention was (ie how far would you have driven had you not been stopped by the police) and the risk posed to other road users.
