advice please,
my partner blew 67 in a rta, no one was hurt but he was arrested,
he had a conviction lc20 (not displaying 'l' plates) 5 years ago
apart from this both of use have no idea of courts/judges etc
hes a family man with house, job & kids, is a prison sentence likely ?
the thought of telling the kids about the ban is crippling me enough :(
 
According to the sentencing guidelines the starting point for an alcohol reading of 67mg in breath is a ban of 17 to 22 months and a fine.
However, the court will take into account aggravating features which make it more serious such as being involved in a collision, which they may regard as evidence of bad driving due to impairment caused by drink.

On the other hand the court will also weigh in the balance any mitigation put forward by you or a drink driving solicitor on your behalf.
