I was pulled over a few days after having a couple to drink. I failed the roadside breath test. But i was NOT given my orders (remain silent etc). Also when i got inside the car it had a extremely strong smell of cannabis. Do i have a case for this if i go to court?

I blew 47 on the station breath test and provided a urine sample. Im currently waiting on the results.

Any advice is would be appreciated.
 
In order to comment on the availability of any legal arguments or defences we would need to see the prosecution papers, including the forms completed by the police during the procedure at the police station, your custody record and the witness statements from the police officers involved to see what they say. This evidence is usually not available until the day you appear in court when it is handed to you. For advice about your prospects you will need a specialist drink driving solicitor in court with you who can very quickly and expertly assess the prosecution evidence and tell you everything that you need to know. I would recommend that you arrange this in advance rathern than on the day. They will also be able to speak to the prosecutor and Magistrates on your behalf and prepare and present your arguments in the event of you deciding the challenge the evidence against you.

In the meantime, you could arrange for your own sample (that you should have been offered when you left the police station) to be independently analysed. If you need help identifying a suitable forensic expert then we would be happy to point you in the right direction.
