High Risk Offender

I was banned for 24 months in October 2010 with a reading of 109mg in my breath. I am shortly to begin the course to reduce my ban to 18 months. I saw that over 85mg in my breath is considered high risk. Is this obligatory? I contacted the DVLA who had not been advised of my reading when I was convicted in October 2010. They have said they are now going to investigate. Can they (DVLA) do this or did the court not consider me to be high risk?

The High Risk Offender scheme does apply to readings of 2 1/2 times the legal limit and above. In the case of driving with excess alcohol in breath, this means readings of 87.5 microgrammes and above. Therefore you will fall within the scope of the HRO scheme - it is not something which is at the discretion of the Court which imposes the sentence.
