Asking for Driving License back after 2 years?

Hi, stupidly i was caught drink driving for the second time and recieved a ban for 44 months. I was offered the DD awarness course again and i completed it, my reduction was 11 months, so my ban was 33 months. I was told that after 2 years had expired (Jan, 18, 2009) i could apply to the court i was sentanced at for my license back. If this is the case, how do i go about this? Also what sort of success rate do people have of acheiving this? Do i have to go court? And do i require a solicitor? Finally is it best to start the process now? :confused:

Yes, in your case, you can apply for the removal of the disqualification after serving two years of your ban. This is done by asking the court that imposed the ban to list the case for a hearing. This usually involves a small fee. When the full hearing is listed, you will be required to attend court. The court will listen to your application, taking into account your character and conduct since the ban was imposed, the seriousness of the original offence and other relevant considerations, such as your reasons for wanting your licence back early. An example of a persuasive reason would be a firm offer of employment conditional on you holding a full licence.

You will be required to attend court, but it is a matter for you as to whether you instruct a solicitor to represent you or not. I would, however, recommend that you instruct a specialist solicitor, as he or she will be experienced at making representations in court and will be able to advise you as to what evidence to rely on. Legal aid is not available and you would have to fund your own legal costs. These costs are not recoverable even if you are successful.

Prospects of success depend on the facts of each case, but a specialist solicitor would be able to give you specific advice based on your individual circumstances. Preparation and evidence are the key.

You will not be able to apply to the court until the expiration date has passed, but there is no harm in going to see a solicitor now and courts can usually list these cases relatively quickly.

A much more detailed approach on how i was to go about this, the DVLA to say the least were very vague, they told me to write to the court i was sentanced at, including a fee, and i would here back from them, through the post. I would just like to add how stupid i have been, to not just drink drive once but to make the mistake again, its very easy to know that it is the wrong thing to do while sober, but unfortunatly under the influence of alcohol we make wrong decisions, in my case ive lost my job, independance, and my long term girlfriend, not to mention the shame ive brought to my family. These are the punishments for my actions, and i say fair enough, for me giving up alcohol is the only way, ive been sober for more then a year now, do i miss it? Not even close to how much i miss my licence.

Hi Kaiden,

You are correct, a lot of people make decisions they live to regret when drunk. Unfortunately drink driving ranks up there with the most dangerous and stupid decisions that can be made while intoxicated. There is often a high price to pay as you well know. All we can do is learn from our mistakes. Just be thankful that things are not a lot worse then they are already, no one was killed or seriously injured and you still have your liberty.

Well done with giving up alcohol, it was obviously a problem. I hope you stay sober and have a long and safe driving career when you finally get your driving license returned to you.
