48mg in breath - waiting on blood...

I got pulled over before Christmas (17th December) for being on a phone while driving. Thames Valley breath test everyone pulled over during the Christmas period.

The basic info:
- I was pulled over at aprox. 9am.
- breath readings were 48 and 51 so I opted for blood or urine and the PC's chose blood.
- I have to have a licence for work and am MD of a car dealership which doesn't really have the ability to function without me - affecting 14 other people.
- I have a clean driving licence

Bailed until 22nd January and waiting on blood results. What is the best way forward?

Firstly, were you provided with your own specimen of blood and, if so, did you have it analysed?

If your lower reading was 48 in breath then I would expect that the blood will be over the prescribed limit, unless there was a considerable delay between the providing of the breath specimens and the blood specimen.

The fact that your license is not only central to your livelihood, but also to your employees' livelihoods will not prevent the Court from disqualifying you.

If you are charged then the best way to proceed is to seek specialist advice immediately as it may be possible to defend your case in Court.

I was given my own sample and I have not had it checked as a solicitor suggest at the time that it wasn't worth checking until the Police got the results back.

In regards to "If you are charged then the best way to proceed is to seek specialist advice immediately as it may be possible to defend your case in Court." - I don't see how the case could be defended if the results are over the limit of 80. Surely it is over 80 and therefore a manditory ban of 12 months or 9 months with a course so any defence won't improve this? Please correct me if I have arrived at this conclusion wrongly.
