Advice needed please

Hi I am looking for some advice on what to do. My husband has been arrested for drink driving on the 28th. He was not driving for the whole night, but his friend stopped to get food, and he took the wheel. He literally was only driving for 5 minutes when he was stopped, and they said he was over the limit. They breathalised his friend, and said his friend was fine, even though they had been drinking about the same. They have given him a court date of the for Jan 11th, but he needs to leave the country on Jan 6th for work. What is going to happen now? and is there any way that the court date can be pushed back?

The offence will still be made out even if your husband only drove for a few minutes.

If convicted of drink driving he will be liable for a period of disqualification and a fine. He may also be liable for a community order or even a custodial sentence in more serious cases. In order to properly advise on sentence we would need to know the exact reading.

It may be possible to adjourn the first hearing in his absence but there is no guarantee that the Court will be prepared to do so.
