Son banned after RTA

My 18 year old son has been banned for 24 months, plus 60 hours unpaid.
No issue with him getting his deserved punishment.

He got pullled after a (thankfully) minor RTA on 3rd Dec. Police were called, failed breath test, 93mg.

It was minor damage to the back of a minicab. My son gave his name and phone number to other driver. He did not get one back. The guy said he would be in touch. Didn't hear anything amd no way to get in touch.

We didn't notify our insurance company because only minor damage and wanted to sort it out with the driver.

Got a call today from insurance (policy has me as main driver). They claim other car is a write off and driver and passengers all have whiplash.

Due to alcohol related incident they are only covering 3rd party and threatening to pursue my son for all the costs.

He has no assets and suggest he can sort out a payment plan!

They expect him to sign some sort on indemnity form - not sure what that means.
Should he get legal advice? Is legal aid possible for this sort of case?
 
Unfortunately this is not a question on which I can properly advise as it is not a matter of criminal law.

You should certainly seek specialist advice as soon as possible. If your son is being asked to sign an indemnity this effectively means that he is being asked to agree to reimburse the insurer for their losses in this matter.
