Hello, I have recently been bailed on drink driving offence to appear in court Dec 11th, my reading was 93. I was arrested a couple of years ago for assualting a police officer, what are my chances of a custodial sentence? Also in your opinion what is the likely outcome with my case?

Is your reading 93ug in breath or 93mg in blood?

Assuming the reading is in breath, you will be liable for a disqualification of 23-28 months and a community order.

If the reading is in blood, you will be liable for a disqualification of 12-16 months and a fine.

In either event you should be given the opportunity to attend a drink driving rehabilitation scheme, the successful completion of which will result in your disqualification being reduced by up to 25%.

A custodial sentence would be well outside of the sentencing guidelines. With these readings the Court would only consider custody in the most extreme cases where there is evidence of significant aggravating features.
