Drunk in charge / drink driving offence

My boyfriend received 10 points for drunk in charge 2 years ago. Last week he failed a breath test (reading of 83) and has been charged with drink driving.

My question is will this be treated as a first or second drink drive offence by the magistrates when calculating the length of the ban?
 
Drunk in charge is not an offence carrying an obligatory disqualification. As your boyfriend discovered it is a discretionary ban. This will be his first conviction for an offence carrying an obligatory ban. As such the two in ten years rule does not apply and the minimum ban will be 12 months, not 3 years.
