Need help 3rd medical requested. trying to catch me out?

First i will tell you the reason for the medical.

I have a medical license, apparently due to me being an alcoholic when i was 16-17. These are not my words, but was put on my file by a doctor when i was admitted to hospital for another unrelated reason. at 17

Me being an alcoholic, is to be blunt complete bollocks.
I dont hardly drink currently (maybe once a month, or less and i dont get drunk) i have been like this for 4 years.

I did hower drink and get drunk, at private parties when i was 16/17.
but It was not every day, or even every week.
nor do i ever remember drinking white lighting in the local kids playgrounds...


This was before I had ever even applied for a provisional driving licence.
I applied at 18, and was refused. because of this note on my medical records i was banned for 1 year.

so one year later, got my provisional license. took a year to learn to drive paid by myself(no previous expericance) passed my theory and pratical

got my full license.

But was given a medical licence, wich means i have to have a review each year.
wich was fine up until around christmas 2009.

I was sent a letter, to take a urine test and medical examination.
i had to have an extension on the date it was booked by(called them and asked) because it was, well christmas.

I did this medical january 2010. everything fine.
I was sent another letter a month later, asking for a repeat urine test, as it was "too pure" or something. them saying i had drunk too much water.
so i booked and took it again.

now months later 1 may. I finally recieve a response.
not what i expected.
Please book a medical examination with this doctor. with no mention about my previos examinations..

It does not ask for a urine sample this time. but i am very annoyed. I have waited months for a reply, and i am inexplicably at stage 1 again.

this is the third request. in five months. for what should be a simple and routiune medical. I really do feel as though this is never going to end. until they find something to stop me driving.

I feel they are trying to catch me out. or something. I feel like a criminal here. and theres nothing i can do.

The DVLA issue guidelines on their web site in relation to various medical conditions. These guidelines are based on advise from a Home Office panel of medical experts appointed by the Secretary of State for Transport. The identity, qualifications and areas of expertise of these experts is also freely available on their web site.

The section on Alcohol Misuse says that persistent alcohol misuse, confirmed by medical enquiry or evidence of abnormal blood markers will result in revocation or refusal of a licence until a minimum 6 month period of contolled drinking or abstinence or normalised blood patterns. The section on Alcohol Dependency says that a minimum 12 month period of controlled drinking or abstinence must be attained.

In cases where somone suffers an alcohol related seizure then a licence will be revoked or refused for a minimum of 6 months fromt he date of the event. Where someone suffers a second alcohol related seizure then the epilepsy rules apply, which means that the licence must be renewed every few years upon medical confirmation of fitness to drive. A licence will only be fully restored following a 7 year seizure free period.

If you don't accept that these medical conditions cover your circumstances then you should arrange a full indepenent medical examination with an approved medical practitioner and appeal, initially to the DVLA themselves, about the manner in which the criteria is being applied to you. If this fails then take specific legal advice from a specialist Road Traffic solicitor about launching a legal challenge against the DVLA.
