I am due in court next month for being charged with drink driving at 128mg in breath. Will I get my punishment that day or will I definately have to go back to a pre-sentencing report? This is my first offence (and last)!

At that level of alcohol you are certainly at risk of an immediate custodial sentence. The guidelines that the court use (which are available elsewhere on this site) say that a prison sentence of up to 6 months should be considered when alcohol levels in breath reach 120 mg. Your Reading exceeds this threshold by some margin.

Having said that we have successfully avoided prison sentences for lots of clients in the past with alcohol levels higher than yours. It is entirely possible that the court will be prepared to suspend any prison sentence or give you a community sentence instead but this depends on how your case is presented.
