I am a 32 year old woman. I was stopped by the police at 4:00am on Sunday. I was breathalyzed and the reading was 128 mg. I have no previous convictions and have had a clean driving license for 5 years. I did not have an accident and had one passanger in the car. I am terrified of a custodial sentence. Is a suspended sentence likely?

At that level of alcohol you are certainly at risk of an immediate custodial sentence. The guidelines that the court use (which are available elsewhere on this site) say that a prison sentence of up to 6 months should be considered when alcohol levels in breath reach 119mg. Your Reading exceeds this threshold by some margin. Having said that we have successfully avoided prison sentences for lots of clients in the past with alcohol levels higher than yours. It is entirely possible that the court will be prepared to suspend any prison sentence or give you a community sentence instead but this depends on how your case is presented.
