Morning after - is it worth defending?

My husband tested +ve this morning (45 microgrammes of alcohol in 100 millilitres of breath) after night out. He has to go back for retest this aft and has court appearance next Fri. He was driving removal lorry from overnight stop to local address (in Scotland). Is it an automatic ban? He is a removals driver and we have 3 young children to support so he really needs the job. Is it worth getting a lawyer (can't really afford it though)?

I would recemmend that your husband does indeed take legal advice. He needs to speak to a Scottish lawyer as this is a different legal jurisdiction to England and Wales.
