Hi, I recently got caught for drink driving and it was my second offence. I am so gutted right now because I should have known better, but for some reason i was not thinking and got into my car! Since my first ban I had learned my lesson and everytime i was drinking i left my car and got a taxi or a lift. I have a mental health condition which means i am housebound most of the time and my car was the only way i was able to get out. Due to my mental health problems i have recently gone off the rails, drinking excessively etc... out of control really! I have totally screwed things up now and made a bad situation much worse. I got caught early in the morning with a reading of 101. I got the minimum 3 year ban and £200 fine as I am only on benefits. They withdrew the community order due to my mental illness. They did not offer me the drivewise course as i was offered it before and did'nt go. The probation officer said i was very lucky and that the court never normally goes that lenient so i gues i should be thankful it was'nt worse. Anyway, I read that you can apply to get your licence back after 2 years if you can staisfy a doctor etc... Just wanted to find out what my likely chancews of doing that would be if i sorted myself out and could show i do not have a drink problem etc... I do not have a drink problem as such, its just when i do drink i cannot stop myself and i have been drinking to excess to blank out my problems. Its never in the week, only at weekends. I plan on getting my life sorted out, gettting my illness sorted out, a regular job etc and controlling my drinking. If i do all these things in the next 2 years and can satisfy the doctor is the court likely to look at it and issue my licence back early?
 
You can apply for the early removal of the disqualification after serving two years of a three year ban. You must apply to the same court that imposed the ban in the first place.

When considering your application the court must have regard to the following criteria:
a) the character of the person disqualified and his conduct subsequent to the order,
(b) the nature of the offence, and
(c) any other circumstances of the case,

If your application is refused then you cannot make another application for at least three months. Preparation is the key. You should call evidence in support of your application. It is a good idea to take specialist legal advice about what evidence you should rely on at the hearing.

If the Court grant your application then because you were banned for three years and fall within the DVLA's "high risk offender" scheme, you must then undergo a medical examination by a DVLA approved medical expert. Only then will the DVLA issue you with a new licence.

Unless the Court specifically ordered you to, you will not be required to sit a re-test.
