Appealing ban for drink driving

I’ve been banned twice for drink driving coming to the end of my first ban can I appeal my second one?

Have you been banned for one offence and then banned for a second offence where the second ban is running alongside the first?

If so then it would depend how long the second ban is for. If the second ban is for a period in excess of 2 years then you can apply for an early return of your licence at the 2 year point but no sooner. The only other right of appeal in respect of the ban imposed would have to have been lodged with the court within 21 days of the original decision made by the court.

Second ban was 40 months
 
At the two year point of the second ban you can apply to the court to ask that they remove the ban early.

The application must be made to the court that imposed the original ban and they will consider the following criteria:

  • The offender’s character and post-conviction conduct;
  • The nature of the offence for which he was convicted; and
  • Any other circumstances of the case.

An application may only be made if:

  • Two years have passed since disqualification of four years or less was ordered; or
  • One half of the period of disqualification has passed, if four years to ten years disqualification was ordered; or
  • Five years have passed if a disqualification for ten years or more was ordered.

If your application is refused, it is possible to renew the application after a period of three months from the date of refusal.
