I’ve been charged with drink driving, blew 109 at the station. It’s my first ever offence in my life. I’ve been driving for 24 years and never had points. I’ve been under a lot of stress at the moment with divorce, selling the family home and custody of my daughter. I know it’s no excuse and I’m ashamed of what I’ve done as I’m the first one to condone. What do you think my punishment will be and will I go to prison?
 
A guilty plea to a charge of driving with excess alcohol with a reading of 109µg of alcohol per 100ml of breath will mean you will be sentenced within the this sentencing bracket. This means that you will face a ban of between 23 and 28 months together with a community order. A prison sentence would not ordinarily be a consideration with a reading of 109µg. The fact that you have a previously unblemished record will be a positive to be highlighted to the court and there are a number of factors that should be outlined to the court to assist with presenting an argument to help minimise the penalty as far as possible.
