Employer being made aware of a drink drive charge before conviction.

I was charged with drink driving around 3 months ago, and pleaded not guilty in court. The case was then adjourned for a further 3 months. However, in between the first and second court hearing the police wrote to my employer suggesting that I may not be suitable for the role. Is this legal and what happened to innocent until proven guilty? Any advice will be much appreciated. Thank you
 
The police do have powers to notify your employer of any on-going proceedings in certain instances however it needs to be reasonable and justified. The 'Common law police disclosure’ guidance provides for this if the circumstances allow and if it is decided that there is a need to do so taking a wider social view. This most commonly effects occupations where there is a responsibility for children or vulnerable adults.

If you work in a regulated profession and potentially face disciplinary action before a regulatory body you should seek specialist advice regarding this matter as soon as possible.
