Default No Insurance - Unaware

My son was involved in a crash recently - no one hurt fortuneatly. His car was towed of the motorway into a storage yard and the highways agency and police attended the scene. Once back at his digs he contacted his insurance company who then informed him that they had cancelled his policy by email because he had missed an installment. He denies ever receiving the email (they have since said they sent 3 on the same day!)

Since then he has received an email from the insurers saying the car had been put into a workshop - he checked with the workshop only to find that it had not been put in there. He contacted the insurance company who again informed him that they had cancelled the policy.

The insurers seem to be an admin nightmare and even though the accident was nearly a fortnight ago he hasn't been contacted by the police - I think this is strange as I would think their traffic car computers would have nabbed him at the scene if he had no insurance.
Although he failed to keep up the payment he says had he known he had missed it he would have pulled some funds from his savings.

Where does he stand?

If the police decide to prosecute it is worth your son getting in touch with us. If the insurance company has cancelled his policy then he is guilty of the offence of driving without insurance.

We have represented uninsured drivers and have successfully argued that Courts should not endorse a driving licence with points where it can be proven that special reasons exist for non endorsement.
