In desperate need of advice here please. Last night I was locked up for a drink driving offense. The thing is I wasn't even driving my car I simply had a few wines with friends while shopping and left to put the roof up on my car at about 8pm last night. And go back inside with friends because there was a domestic at the bar with a few mates the security followed me out for some reason although I had done nothing wrong and the police were watching me go to my car, of course I had to turn the engine on to put my roof back up. The police officer was such a jobs worth, breathalized me there and then and I blew 120 I think , but I still didn't drive my car it was parked in a bay! He arrested me took me to station where I was then breathalized four separate occasions loads of attempts but there machine broke, I still have all the bits if paper off them, I feel like they just wanted to charge me with something, they were horrible to me as we'll, so at 11:30 on I then had to give a sample of blood. I requested a solicitor which I didn't even get to see just a quick five minute conversation! I didn't even get interviewed! I got a bail sheet and got out at 5 this morning, they told me they were sending my blood off and if it comes back with alcohol in it in being prosecuted. Course there's alcohol in it I was having a few drinks with friends I had no intentions of driving my car. Iv rang a solicitor and he is seeing me next Thursday one that specialises in these type of offenses. I'm really upset I have an 18 month old baby boy I'm a single mother and iv been done for drink driving in the past and would never re offend! Can someone please help me :(

If you are prosecuted for drink driving then you will obviously have a full defence to the allegation insofar as you did not actually drive the vehicle. However if you are prosecuted for being drunk in charge of a vehicle then you will have a much more difficult time in proving your innocence. You would need to successfully show to the Court that, on the balance of probabilities, there was no likelihood of you driving your vehicle whilst still over the limit. As you are awaiting the police's response regarding your blood alcohol levels there is very little that you can do at the moment. I advise talking all of this through with your solicitor and seeing what their view is of the case.

Thanks for the reply. My heads completely done in. I have a solicitors app on Thursday, so fingers crossed. :(
