In charge of motor vehicle whist over limit

Yesterday I had too much to drink. I knew I shouldn't drive so waited in my car for my partner to pick me up. The police arrested me for being in charge over the limit. I have a previous DR10 from three years ago. I was 151 microgrammes. I have a hearing in two weeks what should I expect?

If you have been charged with 'drunk in charge' and your previous conviction from 3 years ago is drink driving then your previous won't affect the penalty on this occasion to the same way as if they were both drink driving convictions. Two drink driving convictions in a 10 year period mean that you will be banned for a minimum of 3 years. On this occasion, given that the allegation is 'drunk in charge', there is no mandatory period of ban to be imposed.

You do, however, still run a very real risk of having a custodial sentence imposed due to both the recent previous conviction AND the very high reading on this occasion. I would highly recommend contacting a solicitor to discuss options moving forward in more detail. There is also a possibility of advancing a defence if you had no intention to drive whilst over the limit. This can be run irrelevant of the reading your produced and is something you should also obtain advice about.
