Hi there,

I'm posting this on behalf of my brother, on 2nd of March, he was stopped by police less than a mile from our house. He had been very stupidly drinking that evening since receiving a bad news about our grandfather's health. He knows that was not an excuse and is very ashamed.

After two set of breathalyzer testing (on-road and in the police station), they decided they want to take the blood sample, he was released on bail on 3rd of April since the blood test results were delayed, however, was re-arrested last night after blood test results were given to police. The result was 120miligrams in 100 milliliters of blood.

Looking at this website I understand what the court outcome will be and we have already contacted a lawyer, but just want to make sure we understand everything.

He will be starting his LPC course in London in September after battling through depression for past 6 years finishing his law BSc and LLM he has been very much looking forward to next year, his biggest worry is how criminal record will impact on his future, especially as a future lawyer. He understand the "law and order" better than anyone and he is very ashamed of what has happened but we can't imagine how one mistake is allowed to ruin his future.

Is there any argument the lawyer can make to avoid a possible criminal record?

my second question is about the time it took for blood test to be carried out is almost 50 days the norm? isn't there a maximum time a blood sample is viable?

If your brother pleads guilty or is found guilty after a trial he will not be able to avoid a criminal conviction unfortunately. No amount of mitigation will avoid that. The only way of doing so it to successfully defend the matter. It may be that there are avenues that can be pursued with the help of a specialist solicitor. You should ask him to speak with his solicitor directly about this. The delay in these cases can often be as much as 6 weeks before a result is reported to the police. Any delay is not usually in the analysing of the specimen but in the reporting of the result by way of formal statement/certificate of analysis. If the delay was actually a delay in physically analysing the specimen then this would certainly cause concern over the reliability of the analysis.
