I got arrested last weekend for drink driving and I failed to provide a breath specimen and no Insurence. I am going to plead guilty to these charges as I was bang to rights but I am giving my defence that I must have got spiked as I only had two bottles of beer in the night. Therefor this was so out so out of character and would never do something like this. As I come to my senses in the police station later the next day when I was going for an interview I asked for a blood test as I believed something must have happened to my drink for me to do this offence. I took my sisters car with me not being insured and got pulled over. I am so career minded and now if I loose my licence I will loose my job as I am a damp surveyor and need a licence for my job.

May I add that I have never been in trouble with the police and have a clean driving licence and 24 years of age and had my licence for four years.

As the main allegation you face is failing to provide a specimen rather than drink driving, the issue of how the alcohol came to be in your system is no longer relevant. The police are entitled to request a specimen of breath if there is a reasonable suspicion that you have been drinking and driving. As you have failed to provide, this offence now centres on the reasoning behind that failure. Unless it can be established that you had a reasonable excuse for not providing then defending this will be difficult.

A conviction for this offence will mean a minimum disqualification of 12 months. Your personal circumstances and background will not avoid a ban for this offence if a guilty plea in entered. There are defences available for the allegation of failing to provide. However, you will need to discuss the matter with a specialist solicitor to discuss the circumstances of the allegation in detail.
